The context for this is Michery's statements about "lithium-air battery technology" from the Risk On interview he gave on June 1. 


 
 
At the 12:07 mark, Michery made the following statement: 
“Ultimately the Holy Grail of battery technology would be like a lithium air technology, and we’ve been exploring that for quite some time. You know, we started back in 2017 exploring those possibilities with IBM, and we looked at a coin sized cell that potentially could be the Holy Grail of battery technology which would be on par, if not greater than, the efficiency of gasoline.”

(2) Later on at the 23:56 mark Michery stated: 
“Ultimately, my ultimate goal… look I haven’t given up on lithium air technology. I paid a lot of money to IBM for that, a lot of money, so I’m gonna progress that as much as I can now. Look, I’m not promising I’m gonna get to the finish line but I got engineers that are gonna be dedicated to try to get that IP and solve the issues: (1)the air handling, and (2)the hydrogen peroxide on the cathode, the build up. And maybe somewhere down the line, Mullen could have a lithium air solution that would progress Mullen into the year 3000.” 
 
Michery seems to be implying that Mullen had an ongoing agreement with IBM for lithium-air battery technology. He makes the direct claim that Mullen “paid a lot of money to IBM for that, a lot of money” and implies that work and progress on lithium air battery technology directly stemming from this agreement has been continuing at Mullen. He gives no reasons for a listener to suspect there are any concerns.

(3) But public court records and Mullen Automotive’s own SEC filings indicate that this 2017 agreement failed to progress, and in fact IBM filed a lawsuit against Mullen on May 7, 2019 claiming breach of contract of the original agreement due to failure to pay on Mullen&#39;s part. 
 
This case was filed with the New York Westchester Supreme Court and can be found under Index Number 57306/2019. Judgment against Mullen was issued on Dec. 1, 2021 in the amount of $5.6M. The liability from this litigation has been reported (though buried) in Mullen SEC filings like the 10-Q/A, and even on the day that Michery was giving this interview the company was still appealing the court order to pay IBM.

you have no idea, bc contracts of this size have installment and milestone payments and this was likely the remaining balance of 10-25% of the contract amount.  Maybe MULN did not agree that IBM had fulfilled its obligations under the terms of the agreement and disputed and withheld the last milestone payment.   
 
Having a claim filed against you and the other party being awarded a judgment on a business contract is not considered “dirt”.  Parties in this industry on both sides of a deal need to perform and there are too many variables to speculate.   
 
I highly doubt a company as astute IBM would engage on a project without obtaining a substantial down payment or upfront fee. 
 
This is the most incriminating piece of data you could “dig up”?  Should have saved yourself some time and not even posted.
