But as @doubleoverhead posted, the judge stated that Samsung bears the burden of proof in this bench trial.  They tried to assert equitable estoppel:

@robcobb @doubleoverhead As @BolliverShagnasty put in his synopsis, the judge stopped Samsung and asked what they were actually litigating for.  He even asked if they were wanting him to decide if the patents were SEPs or not.  He felt they were all over the place as we did.  So when the end of they bench trial arrived and they asserted that they were prejudiced because Netlist was saying that the patents weren’t SEPs - the judge chastised them for putting forth any evidence or witnesses to attest to that prejudice.  He even gave them examples of what they could have done, such as provide a patent litigation attorney as a witness and have them testify how something like that would have affected their trial.  He told them that they were too late for that now.

So when the end of they bench trial arrived and they asserted that they were prejudiced because Netlist was saying that the patents weren’t SEPs - the judge chastised them for putting forth any evidence or witnesses to attest to that prejudice.  He even gave them examples of what they could have done, such as provide a patent litigation attorney as a witness and have them testify how something like that would have affected their trial.  He told them that they were too late for that now.

Also, at the end of the unclean hands argument, the Judge chastised both sides for improper behavior.  He cited what the guidance was from pre-trial was, and how he had to keep reigning them in the whole jury trial.  He told Samsung that they kept trying to bring up JDEC, which was prohibited, and sheasby kept trying to bring up that the damages to Netlist should be 2 billion.  What’s odd is that I don’t remember Sheasby trying to bring up 2B during the trial. I only knew about that because @robcobb told me about it.  He was at the pre trial hearings where that came up.  It seemed like the judge was trying to show that he was chastising both side to be even handed.

While playing the video depositions, Samsung included the Korean along with the translation.  Netlist only played the translation.  Samsung complained saying that they had an agreement both parties would play the Korean answer along with the translation.  Sheasby said that they had no such agreement.  The judge told Samsung that he was wondering why they didn’t play they depositions like Samsung did; however he granted them extra time because of it to avoid complaints.

They said the rule states that the numbers in outside negotiations cannot be used against them in the trial.
