$NLST In the 1st Kingston case filed recently, I posted the negotiation history in a 3 part post (part 1 reposted below, part 2 & 3 on my feed Oct 17), where we saw the way Kingston handled things by blowing Netlist off and playing games, something that was been brewing for years with Netlist attempting to negotiate...worth a read! In the new Complaint/suit filed today, there is a new addition to the negotiation history: "On October 29, 2026, Netlist sent Kingston a letter to prompt Kingston to resume licensing discussions with Netlist. THE LETTER NOTIFIED KINGSTON OF THE SETTLEMENT WITH SAMSUNG AND MICRON, AND NOTED THAT “[T]HESE LICENSES CONFIRM THE VALUE OF OUR PORTFOLIO WHILE KINGSTON CONTINUES ITS WILLFUL INFRINGEMENT.” Netlist further wrote that “Netlist remains willing to engage in negotiations with Kingston for a license to all patents and pending applications in our portfolio”.....Kingston has refused to engage, forcing Netlist to file this Action to enforce its patent rights."

$NLST It just gets better and better for Netlist at the ITC which translates to worse and worse for any new respondents: "The Economic Prong of the Domestic Industry Requirement Is Satisfied--- Netlist intends to rely on the investments of itself and its licensees to the Asserted Patents, SK hynix, Samsung, and Micron, in proving the existence of a domestic industry." At the ITC, it started with SK's help against Samsung to get them to a deal...then added Samsung to SK for help against Micron which got them to a deal...and now we have all three SK / Samsung / Micron helping against Kingston + others to establish domestic industry, and ease public interest concerns as well. You can bet Netist will be successful going forward at the ITC, these circumstances are like holding royal flush in Poker...total dominance! AND...what is this??? Things beneath the surface we're not privy to just yet. "COMPLAINANT HAS ATTACHED A COPY OF THE LICENSING AGREEMENT WITH SK HYNIX AS CONFIDENTIAL EXHIBIT 140C;"

$NLST Holding Netlist feels like a bet on a magician...at any time when needed he can pull aces out of his sleeve or rabbits out of a hat...aka newly asserted or newly issued patents against new infringement defendants or ITC respondents. Essentially, Chuck has an ammunition cache and eyes on many downstream players...I can't begin to imagine the patents that have been issued previously but not asserted yet and patents that are in the pipeline to be issued in the near future. This is the most exciting hold anyone has experienced, and proving to continue providing excitement for the foreseeable future! 👁🍿👁

$NLST Netlist’s management recognises that 79 % of its business involves the margin resale of third-party products, and that there is a risk that, by 2028, production capacity may expand, bringing DRAM prices closer to spot prices. However, thanks to the successful engineering of the Lightning architecture, Netlist is mitigating this risk and reducing the proportion of its business derived from reselling third-party products by launching Lightning, which has passed hardware qualification cycles with a leading global OEM, as well as other system integrators, and is now scaling up commercial shipments. Netlist is also developing the CXL NVVault persistent memory platform to fill the niche left by the discontinuation of the Intel Optane range. This product is currently undergoing testing at Intel, AMD and by SoC developers! Netlist is ramping up production of its own solutions, which is why the $16 valuation brings us closer to a new double-digit position.

$NLST I really don’t think our district court cases against Kingston find the light of day. ITC moves much faster and should resolve everything if history is any indication. Maximum pressure being applied on all fronts IMO. We have the recipe for success and we’re definitely using it.

$NLST From my Muse tonight Netlist has filed a second lawsuit against Kingston Technology, in the Central District of California, case No. 8:26-cv-03262, filed today, November 4. It sits alongside the first Kingston suit from October 16 (No. 8:26-cv-03047). Don’t have details.

$NLST I will share this one last time before earnings My good friend works in the memory sector. After the Samsung deal he and everyone working with them started to buy NLST. Last week he said he is buying as much as possible his words were a couple of big players have deals in place to purchase all of NLST new supply and products. He didn’t know the exact margins of the deals but said he was guessing around 82. Percent. So worst case that’s another around 800 million a year plus $200 million in license. Just there is over $1.50 in earnings per share do our forward PE is 1 people. The market will figure it soon trust me

$NLST CEO Hong told us he learned some hard lessons early on during his Korean talk. One was the clock doesn't start until you file suit. Hence the Kingston actions.

$NLST At this point, it’s clear Kingston is not the sharpest tool in the shed. At the most basic level, they are unable to comprehend the significance of Netlist settlements and license agreements with the top 3 global memory providers (Samsung, Micron, SK Hynix). Does Kingston seriously think they have a chance going up against Jason Sheasby?

$NLST who would be surprised if NLSTs next move against Kingston would be the ITC now that we have experience with great law firm partners, who are now familiar with NLST patents ? If we do, we could squeeze/torture them until initial determination and beyond if they don’t bow down. It is costly, but most of the remaining infringers would be deterred to behave like Kingston.

$NLST my Meta Muse is coming through “Netlist filed Inv. No. 337-3946 at the ITC against Kingston (plus Kingston Tech Far East, Lenovo, CDW, Ingram Micro, Insight Direct USA, and Zones), asserting patents 10,025,731; 12,675,407; 11,200,120; and 11,914,481. The last two are new to this fight — the complaint covers DRAM and NAND flash memory devices, which is a wider net than the earlier Kingston suits. That's the third Kingston-related action in three weeks, after the October 16 and November 4 district-court suits.”

$NLST This message is to those that keep begging for Netlist to announce a deal with SK Hynix. Trust me, company executives are not on this message board making business decisions based on you crying for them to make a deal. If they were, I would be quite troubled. The deal will come when the deal comes. You either trust management to make the best decisions for the company or you definitely can sell your shares and not be involved. But to keep coming on here crying for them to announce or make a deal really makes no sense except to try and create negative spin for the company. It’s quite the contrary things have never been better and they are dealing from a position of strength now when negotiating. “Let Hong Cook” He has hired the best lawyers and negotiators to assist in these deals. My bags are packed and I’m on board for the ride. Hope you join the rest of us in making a lot of money very soon!!!

$NLST bought more for a second time. I know what I own can’t wait for the whole world to hear about my company’s amazing earnings that are locked in next Tuesday after the close of market. Can’t wait for SK Hynix deal and someday a Nasdaq relisting. Oh someday a settlement or win from Kingston and the others.

$NLST Memory has existed since the computer age was born. That didn't change yesterday. Focus on the constants, not the noise around them. Just my opinion.

$NLST IMO. Hoping for news very soon!!! The agreement with SK should be announced any moment now... and I hope the agreement with Google is also before the end of this year. It seems like a good sign that Netlist, in its list of infringers, is focused solely on Kingston...

$NLST memory is needed. Don’t let all the noise shake you out. AI, storage..etc isn’t going anywhere.
