All positions pre-Markman in the Joint Chart from March are exactly as post-Markman shown in pic 3—Disputed Constructions on the right side / highlighted.  Furthermore, the ALJ does not have to agree with Staff, and even if losing—where ALJ adopts respondent’s interpretation/construction—Netlist can still prove validity/infringement and win injunctive relief at ITC.

Claim Construction defines the scope of infringement, the goal of infringers is to minimize exposure, different than to completely eliminate.  Netlist’s litigation campaign is about how much and to what extent, not if but when…and we&#39;re getting closer by the day and development...let it all play out!
