The Trump administration on Friday reportedly filed an emergency motion in a federal court to halt a court order requiring it to make full payments for Supplemental Nutrition Assistance Program (SNAP) benefits in November.

According to a report by CNN citing an emergency motion filed on Friday morning in the First Circuit Court of Appeals, attorneys for the U.S. Department of Justice (DOJ) stated that District Judge John McConnell’s order had “thrust the Judiciary into the ongoing shutdown negotiations.”

Separation Of Powers

The Trump administration’s emergency motion also stated that the judiciary does not have the power to issue an order with respect to appropriations or spending.

While the U.S. Department of Agriculture (USDA) provided funding to states to cover partial SNAP benefits for November in accordance with an order issued by McConnell last week, the DOJ made an appeal in this regard as well.

“This unprecedented injunction makes a mockery of the separation of powers. Courts hold neither the power to appropriate nor the power to spend,” the DOJ attorneys stated in the emergency request for a halt to McConnell’s order.

McConnell’s Order

DOJ’s appeal comes after McConnell ordered the Trump administration to fully fund SNAP for November. The judge also accused the Trump administration of withholding SNAP benefits for political reasons and said it was “unacceptable” to wait any longer.

McConnell also stated that 16 million children are at risk of going hungry because of the Trump administration holding back SNAP benefits, according to a report by CNN.

Meanwhile, U.S. equities declined in Friday morning’s trade. At the time of writing, the SPDR S&P 500 ETF (SPY), which tracks the S&P 500 index, was down by 1.01%, the Invesco QQQ Trust ETF (QQQ) fell 1.62%, while the SPDR Dow Jones Industrial Average ETF Trust (DIA) declined 0.59%. Retail sentiment around the S&P 500 ETF on Stocktwits was in the ‘extremely bearish’ territory.
