$CVNA the economy is trending down and rates are going up. This is a nightmare scenario for Carvana. I remain short just a bit sore after the spike today.!

$CVNA I poured thru the 10Q & here is my summary: Revenue growth is masking margin erosion. Q3 revenue rose 42%, yet total GPU fell 5%, adjusted EBITDA margin slid from 11.3% to 10.0%, and EBITDA per vehicle dropped roughly 10%. Loan-sale gains per retail vehicle fell 17%. The wholesale contribution (including ADESA’s marketplace) declined for two straight quarters: $811 in Q1, $801 in Q2, $708 in Q3. Marketplace gross profit also fell year over year. Non-GAAP SG&A per vehicle barely improved despite 39% unit growth. Growth is the headline & growth is compensating for weaker economics but not fixing them. A downturn or tighter loan-sale pricing could squeeze profits further while substantial expenses and debt remain. Selling more cars for less profit per vehicle isn’t fixing the model, it’s making the next rate hike or credit downturn a bigger problem.

If you recall, Hindenburg alleged Carvana sold $800 million in receivables to a suspected undisclosed related party it linked to Cerberus, as Ally pulled back funding. Cerberus’s then-co-CEO, Steve Feinberg, is now Trump’s deputy secretary of defense (the Pentagon’s No. 2 official). Carvana now says the SEC closed its investigation without intending to recommend enforcement action. That connection raises legitimate questions if the SECs decision is independent. It doesn’t prove political interference but I don’t believe in coincidences. Remember that closure is not exoneration, as the SEC itself cautions.

$CVNA Litigation update: On Nov. 5, the judge finished hearing arguments on whether the investor lawsuit against Carvana and other defendants can proceed as a class action. Most ongoing fact discovery has closed. However, a recent dispute involved additional discovery into “Topocalypse,” the internal project name for Carvana’s titling and registration issues. The judge allowed further discovery and additional questioning of Stephen Keim, Carvana’s former director of regulatory operations. The next major milestone is the class-certification decision. That ruling will determine whether the case can proceed on behalf of the proposed investor class. Docket activity may be quieter while the judge considers the arguments. A ruling within the next 90 days is possible, but there is no announced deadline, and it could take longer.

$CVNA boy has that Pentium guy lost tons of money in this stock shorting it or for anyone who thought about listening to him. Pretty sure he’s down 40 percent in just a few weeks. Ugly dude. I’d advise anyone to tune that guy out!!

$CVNA Bottom Line: Carvana is buying top-line volume at the expense of unit profitability. At 43x forward earnings in a high-rate, rising subprime delinquency environment, trading mechanics won today—but fundamental gravity always wins the quarter.
