Ripple CEO Admits He Was Too Early On Clarity Act, Says Stablecoins Are Crypto’s ‘ChatGPT Moment’

<ul class="summary-bullets"><li>The Securities and Exchange Commission issued a new guidance on Tuesday clarifying how securities laws apply to crypto assets and related transactions.</li><li>This comes nearly a year after the SEC lawsuit against Ripple Labs ended.</li><li>The lawsuit revolved around whether the XRP token itself was a security, and Ripple argued that it should be treated separately from its sale contracts.&nbsp;</li></ul>Nearly a year after the Securities and Exchange Commission’s (SEC) high-profile legal battle with Ripple (XRP), the regulator issued new guidance to clarify how federal securities laws apply to crypto assets.The regulatory body&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.sec.gov/newsroom/press-releases/2026-30-sec-clarifies-application-federal-securities-laws-crypto-assets">clarified</a> on Tuesday the framework for determining when a crypto asset may or may not be considered an investment contract and included guidance on staking, airdrops, and token wrapping. The Commodity Futures Trading Commission (CFTC) said it would apply its oversight consistently with this interpretation.&nbsp;At the 2026 Blockchain Summit held at Washington DEC on Tuesday, the SEC Chairman Paul Atkins&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/DigitalChamber/status/2034002537599173063">said</a> that “after the SEC's persistent failure to provide clarity” for “more than a decade,” the commission had to rewrite the investment contract. Under this contract, “most crypto assets are not themselves securities.”&nbsp;<h2 class="st-heading-2">From Ripple Lawsuit To Revised Interpretation</h2>In December 2020, the&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.sec.gov/newsroom/press-releases/2020-338">SEC sued Ripple Labs</a> and its executives, alleging the company had raised over $1.3 billion through an unregistered securities offering tied to XRP, Ripple’s crypto token. The case became central to the agency's approach to applying securities laws to digital assets. Three years later, Ripple won the lawsuit.&nbsp;<a href="https://stocktwits.com/coins/ripple">Ripple’s XRP</a> was trading at $1.51, up by 0.1% over 24 hours. The company contended that the token should be separated from the investment contracts associated with its sale. A crypto asset can exist independently of a securities classification depending on context, according to the SEC's most recent interpretation, which seems to move closer to that distinction.However, the reliance on the&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.law.cornell.edu/wex/howey_test">Howey Test</a> has not been erased. The Howey Test, in place since 1946, is a standardised framework for determining whether a transaction qualifies as an investment contract. The SEC’s new guidance reflects a shift from enforcement-driven ambiguity toward clearer regulatory definitions.Industry experts contend that, because cryptocurrency is decentralized, dynamic, and utility-driven, the Howey Test struggles to apply to it, as it assumes centralized actors and static assets. He said more customers are using staking to earn rewards on their tokens and are exploring decentralized finance tools instead of simply holding the assets. According to an&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.sec.gov/Archives/edgar/data/2099103/000143774926004276/iset20260214_s1a.htm">S-1/A filing</a> from early February, BlackRock is preparing to launch its proposed iShares Staked Ethereum Trust (ETHB), which would allow the fund to stake Ethereum directly and earn rewards from the network. The filing stated that the trust may stake a large share of its Ethereum while keeping some assets available in case investors choose to sell their shares.<h2 class="st-heading-2">Crypto Investment Products Expand Beyond Bitcoin And Ethereum</h2>Amid this broader shift toward active crypto participation, crypto investment products have also grown sharply over the past five years. According to CoinShares’ Digital Asset Fund Flows&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://coinshares.com/corp/insights/research-data/fund-flows-29-12-25/">report</a> from late December, digital asset investment products recorded year-to-date inflows of around $46.3 billion.&nbsp;The report also showed that while Bitcoin and Ethereum products saw recent outflows, newer ETFs tied to digital assets such as&nbsp;<a href="https://stocktwits.com/coins/ripple">Ripple’s XRP (XRP)</a> and&nbsp;<a href="https://stocktwits.com/coins/solana">Solana (SOL</a>) saw inflows following their US launches. Data from SoSoValue&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://sosovalue.com/assets/etf/us-xrp-spot">showed</a> cumulative total net inflows for XRP Spot ETFs stood at $990.91 million, less than $10 million shy of $1 billion, as of Friday’s closing. Total assets under management surpassed $1 billion last week.<a href="http://stocktwits.com/coins/XRP">XRP’s price</a> was trading at around $1.99 in early morning trade on Monday. On Stocktwits, retail sentiment around the altcoin remained in ‘bearish’ territory amid ‘low’ levels of chatter.<h2 class="st-heading-2">XRP ETFs Attract More Capital Than Solana Funds</h2>XRP ETFs have seen greater demand than Solana spot ETFs, which have logged $672.48 million in cumulative net inflows since listings began in late October – a month earlier to market than XRP products.&nbsp;Meanwhile, Spot Bitcoin ETFs have attracted more than $57 billion in net inflows since their January debut, while Ethereum ETFs have accumulated around $13 billion.<h2 class="st-heading-2">Canary’s XRP ETF Sets Early Trading Records</h2>Canary Capital’s XRP ETF (XRPC) was the first product to reach the market, launching on November 13. The fund recorded $58 million in first-day trading volume, the highest debut-day volume among nearly 900 ETFs launched this year,&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/EricBalchunas/status/1989077502300680375">according to</a> Bloomberg analyst Eric Balchunas.&nbsp;The record had previously been held by Bitwise’s Solana ETF (BSOL), which posted roughly $57 million in first-day trading volume before climbing to $72 million on its second session. XRPC went on to attract $234 million in net inflows on its second day of trading, the largest single-day inflow recorded across U.S. XRP ETFs to date.<h2 class="st-heading-2">Wave Of Issuers Brings Rapid Market Expansion</h2>Several issuers followed Canary to market within weeks. Franklin Templeton launched its Franklin XRP ETF (EZRP) on Cboe on November 18. Bitwise listed its spot XRP ETF on the NYSE on November 20, confirming a temporary fee waiver at launch. The same day, 21Shares received SEC approval via Form 8-A for its XRP ETF (TOXR), with trading scheduled to begin on December 1.Grayscale converted its XRP Trust into an exchange-traded fund under the ticker GXRP, with public trading commencing on November 24 on NYSE Arca.
