<ul class="summary-bullets"><li>The Securities and Exchange Commission issued a new guidance on Tuesday clarifying how securities laws apply to crypto assets and related transactions.</li><li>This comes nearly a year after the SEC lawsuit against Ripple Labs ended.</li><li>The lawsuit revolved around whether the XRP token itself was a security, and Ripple argued that it should be treated separately from its sale contracts.&nbsp;</li></ul>Nearly a year after the Securities and Exchange Commission’s (SEC) high-profile legal battle with Ripple (XRP), the regulator issued new guidance to clarify how federal securities laws apply to crypto assets.The regulatory body&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.sec.gov/newsroom/press-releases/2026-30-sec-clarifies-application-federal-securities-laws-crypto-assets">clarified</a> on Tuesday the framework for determining when a crypto asset may or may not be considered an investment contract and included guidance on staking, airdrops, and token wrapping. The Commodity Futures Trading Commission (CFTC) said it would apply its oversight consistently with this interpretation.&nbsp;At the 2026 Blockchain Summit held at Washington DEC on Tuesday, the SEC Chairman Paul Atkins&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/DigitalChamber/status/2034002537599173063">said</a> that “after the SEC's persistent failure to provide clarity” for “more than a decade,” the commission had to rewrite the investment contract. Under this contract, “most crypto assets are not themselves securities.”&nbsp;<h2 class="st-heading-2">From Ripple Lawsuit To Revised Interpretation</h2>In December 2020, the&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.sec.gov/newsroom/press-releases/2020-338">SEC sued Ripple Labs</a> and its executives, alleging the company had raised over $1.3 billion through an unregistered securities offering tied to XRP, Ripple’s crypto token. The case became central to the agency's approach to applying securities laws to digital assets. Three years later, Ripple won the lawsuit.&nbsp;<a href="https://stocktwits.com/coins/ripple">Ripple’s XRP</a> was trading at $1.51, up by 0.1% over 24 hours. The company contended that the token should be separated from the investment contracts associated with its sale. A crypto asset can exist independently of a securities classification depending on context, according to the SEC's most recent interpretation, which seems to move closer to that distinction.However, the reliance on the&nbsp;<a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://www.law.cornell.edu/wex/howey_test">Howey Test</a> has not been erased. The Howey Test, in place since 1946, is a standardised framework for determining whether a transaction qualifies as an investment contract. The SEC’s new guidance reflects a shift from enforcement-driven ambiguity toward clearer regulatory definitions.Industry experts contend that, because cryptocurrency is decentralized, dynamic, and utility-driven, the Howey Test struggles to apply to it, as it assumes centralized actors and static assets. Meanwhile. Bitcoin (BTC) was trading at around $105,800 with retail sentiment also trending in ‘bullish’ territory amid ‘high’ levels of chatter.&nbsp;<a href="http://stocktwits.com/coins/bitcoin">Bitcoin’s price</a> rose more than 2% in the last 24 hours, still 16% below its record high of more than $126,000 seen in October.<h2 class="st-heading-2">U.S. Shutdown May End Soon</h2>The broader crypto and equity markets gained after the Senate approved a procedural vote on a funding package Sunday. The legislation, if finalized, would provide full-year funding for food aid, farm and veterans programs, and congressional operations, while extending funding for most federal departments through January 30, 2026.The Senate has yet to provide final sign-off, but the development signals that the vote may pass later this week, easing uncertainty that weighed on risk assets during the extended government shutdown.<h2 class="st-heading-2">ETF Developments Drive XRP Momentum</h2>XRP’s recent rally is fueled in part by expectations of several spot ETF approvals. Major issuers such as Grayscale, 21Shares, and Franklin Templeton, are preparing to launch XRP ETFs, which could significantly increase institutional involvement in the token.Recent ETF launches have already drawn strong investor interest. The Rex Shares-Osprey XRPR ETF (<a href="https://stocktwits.com/symbol/XRPR">XRPR</a>) recorded $38 million in initial trade volume on its first day. XRP Outperforms Top Cryptos With 12% Rally Amid Market Recovery

The price of Ripple’s native token jumped by more than 12% in early morning trade on Monday – more than double the gains of any other token in the top 10.

Ripple (XRP) announced Wednesday that it has raised $500 million in new funding at a $40 billion valuation, a move CEO Brad Garlinghouse described as the “cherry on top” for the year.&nbsp;“This investment isn’t just validation of Ripple’s growth strategy and business built on the foundation of XRP, but also a clear bet on what the future of crypto will look like,” he <a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/bgarlinghouse/status/1986071514890871293">wrote</a> in a post on X.<figure class="image"><a class="st-link-external" href="https://x.com/bgarlinghouse/status/1986071514890871293" target="_blank" rel="noopener noreferrer nofollow"><img style="aspect-ratio:918/930;" src="https://news.stocktwits-cdn.com/Screenshot_2025_11_05_093312_png_9f8cd347c8.webp" alt="Screenshot 2025-11-05 093312.png" width="918" height="930"></a><figcaption>@bgarlinhouse/X</figcaption></figure><h2 class="st-heading-2">Funds To Accelerate Stablecoin, Custody, And Prime Brokerage Growth</h2>Ripple stated that it will use its new funds to accelerate growth in custody solutions, stablecoins, and prime brokerage services. The company justified its spending, stating that these areas are experiencing an increase in institutional demand, particularly as the regulatory environment surrounding cryptocurrencies in the U.S. continues to evolve.The company has been doubling down on its payments infrastructure since the passage of the GENIUS Act in July. Earlier this year, Ripple acquired stablecoin infrastructure company Rail, integrating Ripple USD (RLUSD) and XRP into a full-service cross-border payments platform. GTreasury, acquired in October, allows institutions to manage trillions in treasury payments and collateral using stablecoins and digital assets.<h2 class="st-heading-2">Plans For Ripple Prime</h2>Ripple also recently completed its acquisition of Hidden Road, now Ripple Prime, where RLUSD is already deployed as collateral. The company said that, since the acquisition, client collateral has doubled, average daily transactions have exceeded 60 million, and the business has tripled in size. It added that Ripple Prime is expanding into collateralized lending for XRP.The company stated that it has processed more than $95 billion in Ripple Payments volumes to date, and earlier this week, its stablecoin, RLUSD, surpassed $1 billion in market capitalization.&nbsp;However, the funding round drew criticism from some in the crypto community. Mert Mumtaz, CEO of Helius Labs and a privacy coin advocate, questioned Ripple’s ethos, saying in a <a class="st-link-external" target="_blank" rel="noopener noreferrer nofollow" href="https://x.com/0xMert_/status/1986075996765003824">post</a> on X, “Citadel leading a round into Ripple XRP is like Pfizer leading a round into heroin needle technology. Prices of cryptocurrencies Dogecoin (DOGE) and Ripple’s native token (XRP) edged lower in early morning trade on Friday amid broader weakness in the cryptocurrency market, despite seeing a record volume of trades on the day of their debut.In fact, among the top 10&nbsp;cryptocurrencies by market capitalization, Dogecoin and XRP bore the heaviest losses.&nbsp;<a href="http://stocktwits.com/symbol/DOGE">Dogecoin’s price</a> fell around 2% in the last 24 hours. Retail sentiment around the meme token on Stocktwits dipped to ‘bullish’ from ‘extremely bullish’ and chatter fell to ‘high’ from ‘extremely high’ levels over the past day.&nbsp;Meanwhile,&nbsp;<a href="http://stocktwits.com/symbol/XRP.X">XRP’s price</a> took a dive of 2.5% in the last 24 hours. Retail sentiment around the token fell to ‘neutral’ from ‘bullish’&nbsp;territory, but chatter remained at ‘normal’ levels over the past day.&nbsp;According to Bloomberg analyst Eric Balchunas, the REX-Osprey XRP ETF (XRPR) saw $37.7 million in volume, while the REX-Osprey DOGE ETF (DOJE) saw $17 million in volume traded on the first day on the market. XRP, Dogecoin Prices Slide Despite Record First-Day ETF Trading Volumes

According to Bloomberg analyst Eric Balchunas, the REX-Osprey XRP ETF saw $37.7 million in volume, while the REX-Osprey DOGE ETF saw $17 million in volume traded on the first day on the market. 

XRP and Dogecoin exchange-traded funds saw strong investor appetite during their trading debut on Thursday.According to an X post by Bloomberg senior ETF analyst Eric Balchunas, the REX-Osprey XRP ETF, which listed on the CBOE under the ticker XRPR, logged a trading volume of $37.7 million, the largest for any ETF listing this year.In just over an hour of trading, XRPR already booked $24 million in activity, which was five times more than any XRP futures ETF achieved on its debut. “That is way more than I would have thought,” Balchunas said before calling it the standout performer of the day.The strong debut highlighted how investors are looking beyond Bitcoin and Ethereum to park their investment. The XRP coin’s market capitalization currently stands at over $181 billion, higher than heavyweights like BlackRock and Boeing. This cleared a significant hurdle for crypto-focused ETFs, as the SEC earlier required a case-by-case review for any new listing.However, major cryptocurrencies edged lower in the early hours of Friday. Bitcoin prices slipped 0.2% to $116,881, Ethereum fell 0.9% to $4,535.55, and XRP slipped 1.3% to $3.04, according to data from CoinGecko.After reaching record highs of $124,000 in August, Bitcoin prices have stayed below $120,000 over the past few weeks, despite record gains in stock markets and bullion.While the Federal Reserve lowered its benchmark interest rates by 25 basis points earlier this week, Chair Jerome Powell struck a cautious tone, which made investors wonder if the Federal Reserve could deliver lesser-than-expected future cuts.On Friday, approximately $3.5 billion of Bitcoin options are expected to expire, according to Deribit data, which could lead to further volatility.Traders on Stocktwits were ‘neutral’ about <a href="https://stocktwits.com/symbol/BTC.X">Bitcoin</a> at the time of writing.
